1. About itoms
itoms is a software-as-a-service (SaaS) platform that enables brands, creators, and organisations to publish content and own their audience directly, without relying on social media algorithms. Content is distributed through three channels: a standalone public site, an embeddable widget, and an email digest sent to subscribers.
itoms is operated by itoms Ltd, registered in England and Wales, with a registered office at 86-90 Paul Street, London, EC2A 4NE.
2. Subscription Plans
itoms offers the following subscription plans, billed in GBP:
- Free — £0/month: 1 standalone site, up to 500 subscribers, 1 team member
- Basic — £50/month: 1 standalone site, up to 5,000 subscribers, 3 team members, custom domain
- Pro — £100/month: up to 3 standalone sites, up to 50,000 subscribers, 7 team members, embed widget, full analytics, CSV export
- Enterprise — Custom pricing: up to 10 sites, unlimited subscribers and team members, branding removal, dedicated support
All prices are in British Pounds (GBP) and exclude VAT where applicable. The applicable rate of VAT will be displayed at checkout.
3. Account Registration
To use itoms, you must:
- Provide accurate and complete registration information
- Be at least 16 years of age
- Maintain the security of your account credentials
- Use one account per person or legal entity
4. Acceptable Use
You agree to use itoms only for lawful purposes. You may not use the platform to:
- Publish content that is illegal, harmful, abusive, defamatory, or infringes any third party's intellectual property rights
- Distribute spam or unsolicited commercial messages to subscribers
- Upload malware, viruses, or any code designed to disrupt the platform
- Attempt to gain unauthorised access to any part of the platform or other users' accounts
- Publish adult content, content that facilitates unregulated financial services, or content that violates the terms of any connected third-party platform (including Instagram and TikTok)
- Resell or redistribute the platform without our prior written consent
We reserve the right to remove content or suspend accounts that violate these Terms, with notice where reasonably practicable.
5. Content Ownership
You retain full ownership of all content you create and publish through itoms. By uploading content, you grant itoms a non-exclusive, worldwide, royalty-free licence to host, store, transmit, and display your content solely for the purpose of providing the service to you. This licence does not permit us to use your content for advertising or any purpose beyond operating the platform.
6. Subscription Billing
Subscriptions are billed monthly in GBP. By subscribing to a paid plan, you authorise itoms to charge your chosen payment method on a recurring monthly basis until you cancel. You will be notified by email at least 30 days before any changes to subscription pricing take effect.
7. Cancellation
You may cancel your subscription at any time from your account settings. Upon cancellation, you retain access to your paid plan features until the end of your current billing period. No further charges will be made after cancellation. See our Refund & Cancellation Policy for full details.
8. Service Availability
itoms strives to maintain high availability but does not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability and will provide reasonable notice for planned downtime.
9. AI-Generated Content
itoms offers AI-assisted caption generation for social media publishing. AI-generated captions are suggestions only. You are responsible for reviewing, editing, and approving any AI-generated content before publication. itoms is not liable for the accuracy or appropriateness of AI-generated text.
10. Third-Party Platforms
The platform allows you to connect Instagram and TikTok accounts for content publishing. By connecting a third-party account, you agree to comply with that platform's own terms of service. itoms is not responsible for content that is removed or restricted by third-party platforms.
11. Limitation of Liability
To the maximum extent permitted by law, itoms Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
12. Disclaimer of Warranties
The platform is provided "as is" and "as available." We make no warranties, express or implied, regarding the platform's fitness for a particular purpose, merchantability, or uninterrupted operation.
13. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes by email at least 30 days before they take effect. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall first be addressed through good-faith negotiation before pursuing formal legal remedies.
